Welcome to Dessert Lady. These Terms and Conditions (“Terms”) govern your use of the Dessert Lady website, online store, ordering services, communications, and related services operated by Dessert Lady Café Ltd, operating as Dessert Lady Cafe & Bakery (“Dessert Lady,” “we,” “us,” or “our”).
By accessing our website, placing an order, creating an account, submitting an inquiry, signing up for communications, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.
1. About Dessert Lady
Dessert Lady Café Ltd provides cakes, desserts, baked goods, catering, custom orders, pickup, delivery, and related food service products and services. Product availability, pricing, pickup options, delivery options, and ordering requirements may vary by item, date, location, and season.
2. Online Orders
When you place an order through our website, you agree to provide accurate, complete, and current information, including your name, email address, phone number, billing details, pickup or delivery information, and any order notes.
All orders are subject to acceptance and availability. We may contact you to confirm order details, request clarification, suggest substitutions, or resolve issues with payment, pickup, delivery, customization, or availability.
3. Pricing and Payment
Prices are listed in Canadian dollars unless otherwise stated. Prices, product descriptions, and availability may change without notice. Applicable taxes, delivery fees, service fees, or other charges may be added at checkout.
Payment must be completed using one of the payment methods offered at checkout. We reserve the right to cancel or refuse an order if payment is declined, appears fraudulent, or cannot be verified.
4. Pickup and Delivery
Pickup and delivery dates and times are selected or confirmed during the ordering process. Customers are responsible for providing accurate pickup or delivery information and being available at the selected time.
Delivery availability may be limited by location, weather, traffic, order type, order size, or operational constraints. Delivery windows are estimates and are not guaranteed unless expressly confirmed in writing by Dessert Lady.
For pickup orders, please arrive during your selected pickup time. Dessert Lady is not responsible for product quality issues caused by late pickup, improper transportation, or improper storage after pickup.
5. Custom Orders and Special Requests
Custom cakes, catering, branded desserts, special designs, inscriptions, allergy notes, dietary preferences, and other custom requests must be submitted accurately and within the required ordering timeline.
We will make reasonable efforts to follow approved custom order details. However, colours, decorations, sizes, designs, ingredients, and presentation may vary slightly from photos, examples, or mockups due to the handmade nature of our products.
Customers are responsible for reviewing all custom order details, including dates, names, messages, spelling, serving size, pickup or delivery details, and design notes before submitting or approving an order.
6. Allergies and Dietary Information
Dessert Lady products may contain or come into contact with common allergens, including but not limited to milk, eggs, wheat, gluten, soy, peanuts, tree nuts, sesame, and other allergens.
Although we may provide ingredient or allergy-related information when available, we cannot guarantee that any product is free from allergens or cross-contact. Customers with allergies, sensitivities, or dietary restrictions should contact us before placing an order and should use their own judgment before consuming our products.
7. Changes, Cancellations, and Refunds
Order changes or cancellation requests must be submitted as soon as possible. Because many products are made to order, prepared in advance, or reserved for a specific pickup or delivery date, changes, cancellations, and refunds may be limited.
Dessert Lady reserves the right to determine whether an order may be changed, cancelled, refunded, credited, or rescheduled. Custom orders, special orders, same-day orders, perishable products, and orders already in preparation may be non-refundable.
If there is a problem with your order, please contact us promptly with your order number, details of the issue, and photos where applicable. We will review the issue and determine an appropriate resolution at our discretion.
8. Product Images and Descriptions
We make reasonable efforts to display product images, descriptions, sizes, colours, flavours, and pricing accurately. However, product images are for reference only. Actual products may vary due to seasonal availability, design changes, ingredient availability, handmade preparation, or display settings on your device.
9. Website Accounts
You may have the option to create a customer account. You are responsible for maintaining the confidentiality of your login information and for all activity under your account.
Please notify us if you believe your account has been accessed without authorization. We may suspend or terminate accounts that appear fraudulent, abusive, inaccurate, or in violation of these Terms.
10. Promotions, Discounts, and Gift Cards
Promotions, discounts, coupons, credits, and gift cards may be subject to additional terms, expiry dates, exclusions, minimum purchase requirements, or usage limits. Promotions cannot be combined unless expressly stated.
We reserve the right to modify, cancel, or refuse a promotion, discount, coupon, credit, or gift card if we believe it is being misused, applied in error, or used in a manner inconsistent with the applicable offer terms.
11. Email and SMS/Text Message Communications
By providing your contact information, you agree that Dessert Lady may contact you about your orders, inquiries, account, pickup, delivery, customer service matters, or other transaction-related communications.
Marketing communications, including promotional emails or SMS/text messages, will only be sent where permitted by law and based on your consent. SMS/text message consent is optional and is not required as a condition of purchase.

Program Name: Dessert Lady Alerts
Program Description: Dessert Lady Café Ltd may send SMS/text messages related to login verification codes, order confirmations, pickup updates, delivery updates, customer service, account notifications, and product availability notifications requested by the customer.
Message Frequency: Message frequency varies based on your orders, account activity, inquiries, and communication preferences.
Message and Data Rates: Message and data rates may apply.
Consent: Consent to receive SMS/text messages is not a condition of purchase.
Opt-Out Instructions: You may opt out of SMS/text messages at any time by replying STOP. After you send STOP, we may send a confirmation message that you have been unsubscribed, and you will no longer receive SMS/text messages from that messaging program unless you opt in again.

13. Acceptable Use
